What To Do If You Are Injured In An Auto Accident

Be sure to do the following if  you’re  injured in a motor vehicle accident:

  1. Take pictures of your car and the other car if possible.
  2. Get names and phone numbers of witnesses.
  3. Go see a medical doctor to be checked out, and follow the doctor’s recommendation for treatment.

  5. File an accident report with DMV within 72 hours of the accident, or as soon as you are physically able to do so.

you fill out an Accident and Insurance Report Form. Give clear information about where, when and how the crash happened. Include all of your contact information and your liability insurance company. The accident will be listed on the driving record of those drivers involved in the accident who meet the reporting requirements.

If you were in a collision and the other party did not have insurance, you should report the collision to the DMV. However, the accident may also go on your driving record, if you do not clearly indicate on the accident report that the accident does not meet mandatory reporting criteria.

If you are the driver or owner of a vehicle in an accident that must be reported, your report must show the name of your liability insurance company, not the insurance agent or agency, and the policy number. The insurance coverage you report is checked by the DMV with the insurance company shown on the report. If you do not report an accident when required to do so, your driving privileges will be suspended.

 

Duties Following An Auto Accident Involving Personal Injury or Death:

 Statute 550.021: ACCIDENT INVOLVING PERSONAL INJURY OR DEATH. (a) The operator of a vehicle involved in an accident resulting in injury to or death of a person shall:

(1)  immediately stop the vehicle at the scene of the accident or as close to the scene as possible;

(2)  immediately return to the scene of the accident if the vehicle is not stopped at the scene of the accident; and

(3)  remain at the scene of the accident until the operator complies with the requirements of Section 550.023.

(b)  An operator of a vehicle required to stop the vehicle by Subsection (a) shall do so without obstructing traffic more than is necessary.

(c)  A person commits an offense if the person does not stop or does not comply with the requirements of this section.  An offense under this section:

(1)  involving an accident resulting in death of or serious bodily injury, as defined by Section 1.07, Penal Code, to a person is a felony of the third degree; and

(2)  involving an accident resulting in injury to which Subdivision (1) does not apply is punishable by:

(A)  imprisonment in the Texas Department of Criminal Justice for not more than five years or confinement in the county jail for not more than one year;

(B)  a fine not to exceed $5,000;  or

(C)  both the fine and the imprisonment or confinement.

Rural car accidents account for more that half of all traffic fatalities in Texas. Single-vehicle crashes were responsible for about 32 percent of all motor accidents deaths in 2008. And, over a thousand people were killed. Intersection crashes also take their toll of deaths.I can tell you from personal experience that Odessa has their fair share of auto accidents.
